Terms of sale

The terms you agree to when you buy something from this website.

These terms apply to every order for physical goods placed through this website. Placing an order means you accept them. They do not cover our training courses or consulting work, which are arranged separately.

Placing an order

Your order is an offer to buy. The contract forms when we send your order confirmation email, not when you click pay.

We may decline an order, for example where a price was published in error, stock has run out, or a payment looks fraudulent. If we decline after taking payment, we refund you in full.

Prices and GST

All prices are in Australian dollars and include GST at ten per cent. The price shown at checkout is the price you are charged. Postage is shown separately before you pay and also includes GST.

Your order confirmation email is your tax invoice and shows the GST component. We can change prices at any time, but never after your order is confirmed.

Paying

Card payments are processed by Stripe. We never see or store your full card number. See our privacy policy for what that means for your information.

Payment must clear before we dispatch.

Availability and mistakes

Stock counts on this site are indicative rather than a live reservation. Two people can buy the last copy at almost the same moment. If that happens we tell you straight away and you choose whether to wait for the reprint or take a full refund.

Obvious errors in pricing or description are not binding on us. If one affects your order we will contact you before doing anything.

Delivery

Delivery areas, costs and timeframes are set out on our shipping and returns page, which forms part of these terms. Risk in the goods passes to you on delivery.

Your consumer guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy you have under the Australian Consumer Law. Any term that would do so is void to that extent.

Copyright

Copyright in our books, card decks and this website stays with the Institute of Capacity Building and its authors. You are buying a copy, not the rights to it.

That means no scanning or reproduction, no reselling it as a digital copy, and no lifting the material into your own training products without written permission. Reading it, using it in your own practice and quoting it with attribution are all fine. Licensing and bulk enquiries to hello@instituteofcapacitybuilding.com.

What the material is and is not

Our books and decks are professional education for practitioners. They are not legal, medical, clinical or financial advice, and they do not replace your own professional judgement, your employer's policies, or the requirements of a funding body or regulator.

Your account

You can buy as a guest or create an account. Keep your password to yourself; you are responsible for what happens under your account, and we can suspend one that is being used fraudulently.

If you bought as a guest and later register with the same email address, those orders are attached to your new account so you can see them.

Our liability

Nothing here limits your rights under the Australian Consumer Law. Subject to those rights, we are not liable for indirect or consequential loss, and our liability for any claim is limited to the amount you paid for the goods it relates to.

Privacy

We handle your information as set out in our privacy policy.

Changes to these terms

We update these terms from time to time. The version that applies to your order is the one published when you placed it, and the date it was last revised is at the top of this page.

Governing law

These terms are governed by the law of New South Wales, Australia, and the courts there have non-exclusive jurisdiction. That does not stop you bringing a claim in the tribunal or court of your own state or territory.

If we cannot resolve it between us, you can contact the Australian Competition and Consumer Commission at accc.gov.au, or the consumer protection agency in your state or territory.
